Administrative License Suspension
When a Georgia driver is charged with a DUI, the DMV will attempt to order an administrative license suspension of your Georgia driver's license. As previously noted, this is a separate process from the DUI criminal proceeding. If the DMV successfully obtains an administrative suspension of your license, it can affect your ability to drive until your DUI case is resolved.
Once you are arrested for a DUI, you have 30 days to file an appeal to prevent your license from being suspended through the DMV. Typically, this is referred to as the “30-day letter.” In your response, you have the option to request an Administrative License Hearing or to install an ignition interlock device on your vehicle. If you take no action within 30 days, your license will automatically be suspended for a year.
DUI Charges Can Have Serious Consequences
Georgia's DUI statute is O.C.G.A. § 40-6-391. A DUI case may involve allegations of driving under the influence of alcohol, illegal drugs, prescription medications, or a combination of substances.
For a first DUI conviction, Georgia law can expose a defendant to jail, fines, probation, community service, a DUI Alcohol or Drug Use Risk Reduction Program, and driver's-license consequences. The exact consequences depend on the facts of the case and the driver's history.
The criminal case may not be the only issue you face. A DUI arrest can also create separate driver's-license issues involving the Georgia Department of Driver Services.

Breath Test DUI Cases
A breath-test result can be important evidence, but the number displayed by a machine does not eliminate the need to examine how the evidence was obtained.
A DUI defense investigation may consider the circumstances surrounding the arrest and testing, the operation of the testing instrument, the qualifications of the operator, applicable testing procedures, and whether other evidence is consistent with the reported result.
Georgia law regulates chemical testing in DUI investigations, and the Georgia Bureau of Investigation establishes requirements concerning approved techniques, operators, and instruments.
A breath-test result is evidence. It does not replace a complete investigation of the case.
Blood Test DUI Cases
Blood testing is increasingly important in Georgia DUI cases, particularly cases involving alleged drug impairment.
A blood-test case can raise issues involving:

The presence of a substance and proof that a person was legally impaired are not necessarily the same question. The particular DUI charge and the evidence supporting it must be carefully examined.
Refused the DUI Test?
A refusal can create significant driver's-license consequences separate from the criminal DUI prosecution.
Georgia's implied-consent laws govern state-administered chemical testing following DUI arrests. Georgia DDS states that an implied-consent refusal can result in a license suspension of at least one year, subject to the particular circumstances and applicable law.
Because driver's-license issues can proceed separately from the criminal charge, do not ignore paperwork you received when you were arrested.
Have your DUI citation, license paperwork, DDS-1205 or other documents reviewed promptly.
Field Sobriety Tests Are Not the Entire Case
An officer may ask a driver to perform roadside exercises during a DUI investigation.
Performance can potentially be affected by circumstances other than alcohol or drug impairment, including physical limitations, footwear, road conditions, lighting, traffic, instructions, nervousness, or other circumstances.
Video evidence can therefore be especially important.

Under 21 DUI Charges
Georgia applies different alcohol limits and licensing consequences to drivers under 21.
Georgia DDS states that a driver under age 21 may face DUI consequences at a BAC of .02 or greater, with suspension rules that differ depending on BAC, testing, refusal, and prior history.
For a young driver, a DUI case can affect driving privileges as well as school, employment, insurance, and future opportunities.
